When the global consistency tool is opened, the consistency tool for a content should also be opened. This is the case in the 3.5 demo (CMSWEB) but when the code has been migrated from the 3.5 CMS, there was nothing that have something to do with this in the code. Perhaps the behavior has been overridden in the 3.5 WEB.
